The contracting authority will exclude any bidder to whom one of the exclusion grounds under § 95(1) of the Estonian Public Procurement Act applies. The confirmations must cover, among other matters, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, enabling illegal employment, illegal use of child labour and human trafficking. The bidder must have no outstanding taxes, charges or environmental fee debts, and contract award must not breach international or Estonian sanctions. If a foreign company is involved, evidence that exclusion grounds do not apply must be provided for that company and the relevant management or representative persons if the contracting authority cannot verify the information in public registers. The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value who are Russian citizens, residents or entities established in Russia, entities more than 50% directly or indirectly owned by them, or persons acting as their representatives or on their instructions. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.

No separate selection or suitability criteria are specified in the European Single Procurement Document. To demonstrate compliance, the bidder must submit a document issued by the manufacturer or an authorised representative proving a valid right to sell, supply and provide the Snowflake Cloud Data Platform licence, product support and maintenance services in Estonia to a state-owned company; this status must remain valid throughout the contract term. The bidder must confirm that the tender complies with the procurement documents and technical requirements, that the offered goods are defect-free, and that it holds the intellectual property and personal data processing rights needed to prepare the tender, participate in the procurement and perform the contract. If the tender is submitted by an authorised person, a power of attorney must be included; for a foreign company, an extract from the commercial register or other evidence of representation authority must be provided. In a joint tender, a joint tenderers’ power of attorney and confirmation must be submitted, and the joint tenderers are jointly and severally liable for contract performance. Where relevant, an equivalent solution must be explained and supported with evidence. The tender must identify and justify any trade secrets; the tender price and numerical figures characterising the tender against the award criteria may not be classified as trade secrets.
