Compliance requirements

The bidder must not have overdue, non-rescheduled debt for state taxes, payments or environmental charges of EUR 100 or more on the bid submission deadline. The contracting authority will check this after opening the bids and will allow three working days to pay or reschedule any identified debt. A foreign bidder must submit a tax clearance certificate issued no more than 30 days before the bid submission deadline, or an explanation and declaration if such a certificate is not issued. The bidder must have submitted all annual accounts whose filing deadline has passed by the bid submission deadline. This is checked through the public register for Estonian bidders. A foreign bidder must submit equivalent evidence or its latest approved annual accounts together with an explanation where the equivalent certificate is unavailable. The bidder must not be bankrupt or in liquidation, have suspended business activities, or be subject to bankruptcy or liquidation proceedings. It must also not be subject to compulsory dissolution or a warning of deletion from the register. Compliance may be checked until the contract is signed; otherwise, the contracting authority may decide not to conclude the contract.

Qualification criteria and exclusion grounds

The bidder must have annual turnover of at least EUR 3 million in construction or design-and-build works in each of the three completed financial years preceding publication of the contract notice. A bidder operating for fewer than three financial years must have reached this threshold in each completed year of operation. If the relevant turnover is not separately visible in the public accounts, a signed turnover statement must be submitted. Where the bidder relies on another entity’s resources, that entity must provide a written undertaking to make its resources available and accept joint and several liability. The bidder or the entity preparing the building design must hold professional liability insurance covering design-related damage for at least EUR 1,000,000 per insured event. The bid must state the insurer, policy number, insured amount and insurance period. An insurer’s or broker’s confirmation of readiness to conclude the required policy is also accepted, but the successful bidder must submit the valid policy within 10 working days after contract signature. The cover must remain valid throughout contract performance and cover damage arising from design defects after handover as required by the contract. During the 60 months preceding publication of the contract notice, the bidder must have properly completed and handed over at least two similar design-and-build contracts under which it carried out both the design, at least to detailed design stage, and the construction under the same contract, including construction of a production building with at least 1,500 m² of enclosed gross floor area. For each reference, the bid must include the object details, scope of work, period, value excluding VAT and the client’s contact details. If another entity’s experience is used, that entity must perform the relevant works during contract performance. The team must include at least the following specialists, whose qualifications must remain valid from bid submission throughout contract performance: - project manager: construction qualification at least level 7 and, during the previous 60 months, experience managing at least one design-and-build contract for a production building; the project manager and site manager must be different persons; - site manager: construction qualification at least level 6 and experience during the previous 60 months managing construction works for at least one completed production building with at least 1,000 m² of enclosed gross floor area; - chief designer: construction qualification at least level 7 covering building design and experience managing the preparation of at least one production-building design of at least 1,000 m² of enclosed gross floor area, completed at least to main design stage; - specialist responsible for heating, ventilation and cooling systems design: qualification in the relevant field at least level 7; - specialist responsible for electrical installations, low-voltage and automation systems design: electrical or automation qualification at least level 7. The bid must identify the specialists, provide their qualification certificate numbers and submit the required reference details and client contacts. Foreign qualifications must be supported by evidence of equivalence. If another entity’s resources are used, that entity must participate in contract performance in the relevant role. The bidder must submit the completed price form. Quantities and unit prices must be entered in the form; rows may not be added, deleted or renamed, and the formulas and structure must not be changed. The total stated in the procurement system must match the total on the price form. The bidder bears the full quantity risk, and the price must cover all works necessary to perform the contract through obtaining the use permit. The bid must cover the detailed design of all required disciplines, design management, BIM coordination, the federated model, clash detection, approvals, energy-efficiency calculations, expert reviews and as-built documentation. Supply and installation of solar power plant and battery storage equipment are excluded, but the associated preparatory and connection works and coordination with the installer are included. An initial schedule must be submitted showing the design and approval stages, completion of the design stage required for the building permit, the main construction stages and the application for the use permit. The bid must remain valid for at least 90 days. The proposed period may not exceed 420 calendar days, the schedule must allow the use permit to be obtained within 450 calendar days, and the works must meet the 24 March 2028 deadline. The warranty period must be at least 36 months. The bidder must accept the draft contract, confirm that it has reviewed the procurement documents and site conditions, and confirm readiness to provide the required guarantees and insurance. If an equivalent solution is offered, its list and technical data must be submitted.
