Compliance requirements

A bidder will be excluded if any of the exclusion grounds specified in Section 95(1), points 1–5 of the Estonian Public Procurement Act apply. The contracting authority may also exclude a bidder on the grounds set out in Section 95(4), points 2–12. The bidder must confirm that these grounds do not apply. The bidder must also disclose any persons authorised to represent, make decisions for or control the company who are not visible to the contracting authority in the company’s commercial register record; where such persons exist, their name and personal identification code must be provided, or the bidder must confirm that no such persons exist. The bidder must confirm that it does not breach any participation restriction imposed by the contracting authority based on the company’s place of residence or registered office.

Qualification criteria and exclusion grounds

The bidder must be entitled to broker Microsoft Enterprise Agreement contracts in Estonia, meaning that it must hold Microsoft Licensing Solution Partner (LSP) status. Evidence of the LSP status must be submitted with the bid. The bid must comply with all requirements set out in the tender documents, and conditional bids are not permitted. The bidder must submit the total price excluding VAT in the required structure and provide the completed pricing form based on the specified licence and quantity list. If an equivalent solution is offered, its equivalence must be explained and supported by evidence. Joint bidders must appoint an authorised representative and submit a power of attorney. The bidder must identify and justify any information treated as a trade secret; the bid price and other prohibited price-related indicators may not be classified as trade secrets.
