Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members or authorised representatives is subject to exclusion grounds. The checks cover, among other matters, convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and illegal child labour or human trafficking. They also cover breaches of tax and social security payment obligations, bankruptcy or insolvency and liquidation proceedings, assets administered by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest and involvement in preparing the procurement in a way that may create an undue advantage. Exclusion may also result from a serious or repeated breach of a previous contract, false information, failure to provide required documents, improper acquisition of confidential information, or breaches of environmental, social or labour law obligations. National grounds also apply in relation to employing an unlawfully staying foreign national, international sanctions and tax offences. For tax and social security debts, the notice states that the tax authority may not issue a debt certificate where the tax debt is below EUR 100 or payment has been deferred. Where an exclusion ground exists, evidence of remedial measures may be submitted where permitted by the tender documents.
Qualification criteria and exclusion grounds
The bidder must submit the completed technical description and compliance form and a free-form technical specification enabling the contracting authority to verify compliance with all requirements in Annex 1. The offered device must be authorised for use in EU countries, comply with applicable requirements and bear the CE marking; supporting documents must be provided.
The team must include at least one medical equipment specialist meeting the contracting authority’s requirements. The specialist must have completed manufacturer training and have at least one year of experience repairing, maintaining and configuring the offered device. The bidder must provide the specialist’s name, job title and contact details, together with a manufacturer training certificate in Estonian or English. The contracting authority may request additional evidence of experience where necessary.
The tender must include the manufacturer’s original English user manuals, including the service and repair manual, as well as Estonian methodological, operating, maintenance and safety instructions. The English documents must be submitted electronically with the tender and in paper form when the device is handed over; the Estonian documents must be submitted both electronically and in paper form upon handover. The manufacturer’s maintenance procedure and warranty conditions must also be provided.
The tender price must follow the prescribed structure and be stated in euros excluding VAT, with up to two decimal places. It must include the device and delivery, maintenance, all costs and taxes payable during contract performance. A post-warranty repair hourly rate must also be provided. The tender must comply with all procurement documents; conditional tenders are not permitted. If an equivalent solution is offered, its equivalence must be explained and supported by evidence. In a joint tender, a power of attorney for the joint bidders’ representative must be included. If the bidder relies on another entity’s resources, a properly completed and signed consent using the required form must be submitted. The tender must identify the contract signatory and contract contact person, and include a power of attorney where the contract is signed by an authorised representative.
