Compliance requirements

Each consortium member is treated as a bidder, and the beneficiary checks the successful bidder’s exclusion grounds (or those of all consortium members). The bidder must confirm that none of the exclusion grounds under sections 95(1)(1)–(3) and (5) of Estonia’s Public Procurement Act, taking account of section 95(2), apply; that it is not bankrupt, being liquidated, subject to bankruptcy or liquidation proceedings, suspended from business, or in a comparable situation under the law of its country; and that it has no outstanding state taxes, duties, environmental charges, taxes or social security contributions under the applicable law. The bidder must also confirm that it is not a related party of the technical consultant advising the beneficiary on the apartment building’s reconstruction. The bidder must confirm that, during the reference period, its employees’ average wages exceeded 70% of the average wage for the same period in the sector corresponding to the contract. The reference period is the six calendar months ending with the month that precedes by two months the calendar month in which the procurement procedure began. The bidder must provide an extract from the Estonian Tax and Customs Board proving this; a foreign bidder must provide evidence from an equivalent competent authority in its country. In a consortium, each member must provide evidence.

Qualification criteria and exclusion grounds

The requirements apply to all lots. - The bidder must be registered for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, it must also be registered for construction and installation of electrical installations. Foreign bidders may provide equivalent evidence of competence instead of Estonian register entries. - The bidder’s net turnover in the financial year preceding the start of the procurement procedure (2025 if its financial year is the calendar year) must be at least twice the estimated contract value excluding VAT. The actual turnover amount must be stated to the nearest euro; the estimated contract value is not specified here. - The bidder must confirm that, by the contract signing date or within 10 calendar days after signing at the latest, it can provide a performance-period guarantee equal to 5% of the contract value. An approved guarantee from a credit or financial institution is acceptable, as is depositing the corresponding amount in the beneficiary’s or a notary’s account, with the beneficiary remaining entitled to it throughout the construction period. Consortium members may satisfy this requirement jointly. - During the 60 months preceding publication of the procurement procedure, the bidder must have completed at least one equivalent construction project as main contractor, worth at least half the estimated contract value excluding VAT. The project must have involved construction, extension and/or full-building reconstruction and included construction or reconstruction of the load-bearing structures and external envelope, heat-recovery mechanical ventilation, and a new heating system. Completion must be evidenced by a handover and acceptance certificate signed by the client and contractor, or by a reference to the building register’s use notice or occupancy permit. - The construction team must include a project manager with at least a level 6 building engineer qualification specialising in building construction and construction activity management, or a level 6 construction manager qualification specialising in general construction; a site manager with at least a level 5 construction works supervisor qualification specialising in general construction; a level 6 heating, ventilation and cooling engineer qualified to manage construction of heating and ventilation systems, or a level 6 construction manager specialising in indoor climate systems; and a level 6 water supply and sewerage engineer qualified to manage construction, or a level 6 construction manager specialising in building water supply and sewerage systems. Electrical works require a person with at least a class B electrical competence certificate or a level 6 electrical engineer qualification for consumer electrical installations. A level 7 authorised architect must be responsible for compliance of the building design with the New European Bauhaus requirements. Foreign bidders may provide personnel with equivalent competence. The named personnel must participate in the works, and their names and qualification or competence certificate numbers must be provided. - The bidder must have a quality management system for construction works meeting at least EVS-EN ISO 9001 and an environmental management system meeting at least EVS-EN ISO 14001, or equivalent documented requirements. Certificates may be checked in the Estonian Quality Association database; if verification is not possible there, the bidder must provide a valid certificate or other relevant evidence on request. - The bid must comply with the procurement documents and be submitted using the beneficiary’s bid-price form; conditional bids are not allowed. Any claimed equivalence must be explained and supported with evidence. The bid must be submitted by a legal or authorised representative; an authorisation must be provided if the signatory is not a statutory representative. Consortium bids require a power of attorney specifying each member’s share and the nature of its contract work; consortium members are jointly and severally liable for performance. Written consent is required for any team member who is not employed by a bidder or listed as its qualified person in a public register. - No specific award criteria were stated in the extracted documents; check the official tender documents for the award method.
