Compliance requirements
The bidder must confirm that none of the applicable exclusion grounds apply to the company or its relevant representatives. These grounds include final convictions within the last five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations, unless the obligations have been paid or covered by a binding arrangement. Other grounds include an arrangement with creditors, bankruptcy or insolvency proceedings, liquidation or court/administrator control of assets, suspended business activities, serious professional misconduct, anti-competitive agreements, an unmanageable conflict of interest, involvement in preparing the procurement, serious or repeated failures under previous public contracts, false or incomplete information, failure to provide required documents, or attempts to improperly influence the procurement. The notice also covers breaches of environmental, social or labour-law obligations, unlawful employment of persons staying in Estonia, international sanctions, and convictions for tax-related offences. If an exclusion ground exists, the bidder may provide evidence of reliability-restoration measures where permitted by the applicable rules. The bidder must provide the required confirmations and, where requested, supporting evidence for the company and relevant representatives.
Qualification criteria and exclusion grounds
The bidder must be able to supply Tableau software licences and Estonian-language product support for one year. It must have the specialists needed to provide product support and must maintain the necessary manufacturer representation rights and support capability from licence activation until the end of the licence period. The bidder must hold the manufacturer’s right to resell the relevant licences in Estonia and must submit a copy of the supporting document or a reference to the manufacturer’s or cooperation partner’s website. If the right is demonstrated through a cooperation partner, the bidder must submit both proof that the partner is authorised by the manufacturer and proof of the partner’s cooperation with the bidder, or equivalent website references. The bidder must provide the product-support email address and telephone number. The offer must comply with the tender documents and may not be conditional. If an equivalent product is offered instead of Tableau, its equivalence must be explained and supported by evidence. The bidder must also submit the required contract-signing and contract-performance contact details, including the signatory’s name, authority and position, the contract contact’s details, and the IBAN. Any consortium must appoint an authorised representative and submit the relevant power of attorney. The bidder must confirm that it, its consortium members and intended subcontractors are established in Estonia, another EU Member State, an EEA contracting state or a country covered by the WTO Government Procurement Agreement, and that the offered goods are not subject to international sanctions or sourced from sanctioned areas.
