Compliance requirements
The bidder, or any member of its administrative, management or supervisory body, procurator, or other person authorised to represent, control or make decisions for the bidder, must not have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering or terrorist financing offences. Such persons must also not have been convicted of enabling the employment of an unlawfully resident foreign national or violating the conditions for employing a foreign national in Estonia, including paying less than the legally required wage, or of unlawful child labour or human trafficking offences. The bidder must have no outstanding national tax, duty or environmental charge debt, or tax or social security contribution debt under the law of its country of establishment, and awarding the contract must not breach an international or Estonian sanction. The bidder must confirm that none of the mandatory exclusion grounds apply. Only companies established in a European Union Member State, a European Economic Area contracting state or a country party to the World Trade Organization Government Procurement Agreement may participate; the bidder must confirm that it is not established or resident in a third country.
Qualification criteria and exclusion grounds
No separate selection or suitability criteria were specified in the European Single Procurement Document. To meet the compliance requirements, the bidder must be authorised by the manufacturer to sell the products and services covered by the tender in Estonia and must submit documentary proof or a certificate of that authorisation. The bidder must submit an application to participate in the procurement procedure, a technical proposal, the complete manufacturer's specification for the offered product, and Technical Description Annexes 1 and 2 with the required confirmations. The submitted documents must allow compliance with the tender documents and technical description to be verified. The bid price must be submitted in the structure specified in the evaluation criteria and priced indicators document. The bid must comply with all tender-document conditions; conditional bids are not permitted. For a joint bid, a power of attorney for the joint bidders and a designated authorised representative must be provided. Where relevant, equivalence must be explained and evidence of equivalence submitted. The bidder must identify any information claimed as a trade secret and justify that classification; the bid price and relevant numerical figures used for evaluation may not be classified as trade secrets.
