Compliance requirements
Mandatory exclusion grounds include, among other things, cases where the bidder or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent it has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering or financing of terrorism; enabling illegal employment or violating the conditions for the employment of a foreign national; illegal use of child labour or human trafficking; or where the bidder has tax, fee, environmental charge or social security contribution arrears. The contracting authority may also exclude a bidder if it has seriously or repeatedly breached a previous public contract or has submitted false information about qualification or failed to submit required information or documents. The bidder must confirm that none of these grounds apply. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of which must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting parties and, in the case of public procurements, the reference numbers. Upon request by the contracting authority, evidence of proper performance of the similar electrical construction contracts must be provided, unless the authority can obtain the information from public or its own databases without significant cost. In addition, the team must include a worker with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the deadline for bids, a person appointed as responsible for the work operation, and a lead electrician with valid A-competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, who has the relevant certificate at the time of submission and is also entered into the EPP before the deadline. The bid must include the price table and all unit price fields must be completed. If the right of representation does not arise from the articles of association, a power of attorney must be attached.
