Compliance requirements
The contracting authority will exclude a bidder if the bidder or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder has a final conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; if the bidder has been convicted for unlawful employment of foreigners or for violating the conditions for employing foreigners; if the bidder has been convicted for unlawful use of child labour or human trafficking; if the bidder has tax debts or social security contribution debts; or if awarding the contract would breach an international sanction or a sanction of the Government of the Republic. The bidder must confirm that no exclusion grounds apply. A foreign bidder must provide evidence that these circumstances do not exist.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment if this is required by that country's law. If registration is required, the bidder must provide a copy of the relevant proof of registration. An Estonian bidder does not need to submit a register extract.
For technical and professional capacity, the bidder must have personally performed at least one similar study, analysis or engineering work within the 7 years before the publication of the procurement, with a total value of at least EUR 70,000. A similar assignment means a conceptual technical solution for the reconstruction or modernisation of a boiler or steam generator of a coal-fired power plant, combined heat and power plant or other industrial steam production unit with at least 200 MW of electrical or thermal rated capacity.
The reference work must cover at least three of the following activities: thermal and process engineering calculations for the boiler or steam system; analysis of boiler operating modes and load ranges, including part-load and full-load conditions; analysis of boiler-turbine interaction for steam production; assessment of the technical feasibility of using different fuel types or fuel blends; conceptual development and comparative assessment of reconstruction options; and preparation of investment and reconstruction cost estimates.
The reference must have resulted in a feasibility study, concept design, preliminary design or other equivalent engineering analysis. The bidder's role, area of responsibility and participation in the work must be visible from the reference.
The bidder must submit a list of the most important similar contracts completed by the bidder and/or its subcontractor during the 7 years before the start of the procurement, including information on their value, dates and the other contracting parties, using the contracting authority's Form 1 "List of contracts" or an equivalent document containing the same data.
