Compliance requirements

The bidder will be excluded from the procurement procedure if any of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the company. These grounds cover participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, enabling illegal employment of a foreign national or violating wage requirements, illegal use of child labour or trafficking in human beings, tax debts, and breaches of international or Government sanctions. The bidder must confirm that none of these exclusion grounds apply to it.

Qualification criteria and exclusion grounds

The bidder must be entered in the commercial register of its country of establishment, if this is required by the laws of that country. If registration is mandatory, a copy of the document proving registration must be submitted; an Estonian bidder does not need to submit a registry extract. Copies of documents proving the qualifications and competence of the persons responsible for the works must be submitted. At least one person managing electrical works is required, with at least a Class B competence certificate or an equivalent or better certificate. A foreign bidder or its foreign subcontractor that does not have documents issued in line with Estonian requirements must submit the corresponding qualification and competence documents from its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority. The bidder and/or its subcontractor must have completed at least one contract similar to the subject of the tender within the last 60 months before the start of the procurement, related to the installation of emergency lighting. Form 2, “List of contracts”, must also be submitted with the dates of the contracts and the other contracting parties. If the bidder relies on a subcontractor’s reference, the subcontractor must be added to the subcontractors table.
