Compliance requirements
The bidder must confirm that neither it nor persons with management, representation or control authority have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, or offences involving child labour or human trafficking. The notice also addresses payment of taxes and social security contributions, bankruptcy or insolvency proceedings, liquidation, suspended business activity, arrangements with creditors, serious professional misconduct, anti-competitive agreements, conflicts of interest, serious breaches of previous public contracts, and the submission of false or missing information. National exclusion grounds may also apply in relation to employing an unlawfully staying foreign national, international sanctions, tax offences and restrictions on participation in the procurement. The bidder must confirm that the offered goods are not subject to sanctions and do not originate from sanctioned regions, and that it will not involve subcontractors or suppliers covered by the Russian sanctions restrictions for more than 10% of the contract value. Where an exclusion ground exists, remedial measures and supporting evidence may be considered where legally permitted.
Qualification criteria and exclusion grounds
Within the 36 months preceding publication of the contract notice, the bidder must have sold and properly installed a diesel-generator-based backup power system or solution at least three different autonomous infrastructure sites. The sales and installation experience must have been obtained under one contract. The ESPD must include a description of the system, the names and locations of the sites, the contract value, the contract award and completion dates, and the contracting partner’s name, registration code and contact details; the contracting authority may verify the information with the contracting partner. The offered solution must comply with the technical specification. The tender must include the technical specification and offered-goods form, technical documentation, the generator manufacturer’s technical data sheet, and a document showing fuel consumption at the maximum permitted load in litres per hour. The bidder must be the generator manufacturer’s official representative or a partner authorised in writing by the manufacturer, with factory support for maintenance, warranty work and spare-parts supply valid at least until the end of the mandatory three-year warranty period; this must be evidenced by a manufacturer-issued document. The bidder must state the delivery time in full weeks, the equipment installation time in full days, and the time from installation to handover of the backup power system, including the relevant documentation, in full days. A three-year warranty must be offered for the equipment and installation works; the tender must also state whether a two-year additional warranty is available and, if so, its total price excluding VAT. The tender price must include the system and all works and costs necessary for proper contract performance. Within 30 calendar days after contract signature, and before starting the works, the successful bidder must take out public liability insurance with coverage of at least EUR 250,000 per insured event. The insurance policy or insurer’s confirmation must be submitted within 45 calendar days after contract signature and before the works begin. Conditional tenders are not permitted. For a joint tender, all joint bidders must sign and submit a power of attorney, specify each party’s share and confirm joint and several liability. If relying on another entity’s capacity, the bidder must submit a signed consent from each such entity. If an equivalent solution is offered, the bidder must provide an explanation and evidence of equivalence.
