The bidder must not be subject to exclusion grounds, including a final conviction within the last five years, or a continuing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and human trafficking offences. Compliance with tax and social security payment obligations is also checked. In addition, there must be no breach related to employing a foreign national who is unlawfully staying in Estonia, no prohibition arising from sanctions and no local tax debt of the contracting authority’s location where this exclusion ground is applied in the procurement documents. The bidder must provide the relevant declarations in the ESPD and, where necessary, the required information and evidence; remedial measures may be described if an exclusion ground applies.

The bidder must have properly completed at least one passenger transport services contract during the 36 months preceding the start of the procurement, with a contract value of at least EUR 20,000 excluding VAT. The ESPD must include a list of completed contracts with the contract period, value, contracting authority and contact details, and the reference number where the contract was awarded through a public procurement procedure. The tender must confirm compliance with the procurement documents. For a joint tender, a power of attorney for the joint bidders and a confirmation of joint and several liability must be submitted. If the bidder relies on another entity’s capacity to meet the qualification requirements, that entity’s consent to participate in contract performance must be provided.
