Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory board members, procurists or authorised representatives have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. Compliance with tax and social security payment obligations is also checked; for tax debt, the notice states a threshold of EUR 0, while tax authorities may not issue a certificate for debt below EUR 100 or for rescheduled tax debt in the circumstances specified by law.
The bidder must also not be bankrupt, in liquidation, subject to insolvency or liquidation proceedings, under an agreement with creditors, or have suspended business activities. The bidder must not have seriously breached professional, environmental, social or labour-law obligations, distorted competition, be involved in an unresolved conflict of interest, or have participated in preparing the procurement in a way that gives it an unjustified advantage. Previous early termination of public contracts, damages or comparable sanctions are also relevant, as are cases involving false information, failure to provide material information or failure to submit requested documents. Confirmation is also required regarding the employment of unlawfully residing foreign nationals, international sanctions and convictions for tax offences. Where an exclusion ground exists, the bidder may submit evidence of remedial measures restoring its reliability to the extent permitted by the tender documents.
Qualification criteria and exclusion grounds
The bidder’s annual net turnover from the sale of medical devices must have been at least EUR 60,000 in each of the last three financial years. If the business has operated for less than three years, the requirement is calculated as the average turnover over the period of operation. The successful bidder must provide turnover data at the contracting authority’s request if the information cannot be obtained from public databases.
Within the 36 months preceding the start of the procurement, the bidder must have completed at least three separate sales transactions involving the sale and maintenance of medical devices: one transaction worth at least EUR 60,000 and two transactions worth at least EUR 30,000 each. At the contracting authority’s request, the bidder must provide evidence of proper performance, such as a client confirmation or handover and acceptance certificate.
The tender must comply with the tender documents, and conditional tenders are not allowed. The bidder must complete the technical specification in Annex 1, submit the manufacturer’s technical description or other documentation enabling compliance assessment, and provide certificates proving the training of at least two service engineers or technicians who are proficient in spoken and written Estonian and trained to repair and maintain the offered equipment. The tender must follow the structure specified on the award criteria and evaluated indicators sheet. Where relevant, equivalence must be explained and supporting evidence submitted. In the case of a joint tender, a power of attorney for the joint bidders must be provided. The supplied goods must have a warranty of at least 12 months; warranty work must be carried out at the bidder’s expense and faults must be remedied within 48 hours unless spare parts need to be ordered. The manufacturer’s maintenance schedules must also be submitted.
