Compliance requirements
The bidder must confirm that the company, its management or supervisory board members, and its legal representatives are not subject to exclusion grounds. The checks cover, among other matters, final convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the illegal employment of children or other forms of human trafficking. The contracting authority also checks payment of taxes and social security contributions, bankruptcy or insolvency and liquidation proceedings, agreements with creditors, administration of assets by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, material breaches of previous public contracts, and the submission of false information or failure to provide required documents. Additional national grounds concern enabling the employment of an unlawfully residing foreign national, international sanctions and tax offences. The threshold for tax and social security contribution arrears is stated as EUR 0. Where an exclusion ground applies, the bidder may, where legally and procedurally permitted, submit evidence of remedial measures demonstrating restored reliability.
Qualification criteria and exclusion grounds
The bidder must have at least one experience of providing a financial service, namely leasing, to at least one person during the 36 months preceding the start of the procurement. The reference must include the name and telephone number of the person who concluded the leasing agreement, together with the contract description, value, period and client details. The bid must include the proposed vehicle's technical description, a completed draft leasing agreement and a total-cost calculation. The price must be submitted in the structure specified by the contracting authority, with each cost component shown separately. The total cost must include the initial payment, applicable interest, the one-month EURIBOR applicable at the time of submission, residual value and other relevant costs; maintenance costs are excluded from the total cost. Conditional bids are not permitted. Joint bidders must appoint an authorised representative and provide a power of attorney. The bidder must identify and justify any trade secrets, but may not classify the bid price or numerical figures related to evaluation as trade secrets. Where necessary, equivalence must be explained and supporting evidence provided. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from a sanctioned region.
