The bidder must confirm that neither the bidder nor its management or supervisory board members or authorised representatives have, during the last five years, been finally convicted of serious offences listed in the ESPD, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or human trafficking. Compliance with tax and social security payment obligations is also checked, as are offences related to enabling unlawfully resident foreign nationals to work and matters involving international sanctions. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. Where an exclusion ground exists, evidence of remedial measures restoring reliability may be submitted in certain cases. The required declarations and any supporting evidence must be provided in the ESPD and checked against the tender documents.

The bidder must have, in Estonia, a maintenance and repair specialist available throughout the period from delivery of the equipment until expiry of the procurement contract. The specialist must have been trained by the manufacturer to maintain and repair the offered equipment, demonstrated by a manufacturer-issued training certificate. The bidder must submit a four-year preventive maintenance plan together with the manufacturer’s instructions specifying the maintenance frequency and the work to be performed. The bidder must be the official representative or reseller of the offered product in Estonia and must provide the manufacturer’s confirmation of representation and sales rights. Where necessary, the bidder must explain the equivalence of the offered solution and provide supporting evidence. The bid must be unconditional, comply with all tender document requirements and present the price according to the required pricing structure. If the contracting authority has not previously inspected the equipment, the bidder must be prepared to provide a demonstration device; delivery may take up to 10 working days and the inspection may take place within two weeks after tender opening.
