Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members have been finally convicted in the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, participation in a criminal organisation, commission of a terrorist act or offences related to terrorist activity, or any other exclusion grounds listed in the ESPD. If an exclusion ground exists, the bidder may submit evidence of self-cleaning where permitted. The bid must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas, and that the bidder will not use a subcontractor who must be replaced in the performance of the contract in accordance with the law and the procurement documents.
Qualification criteria and exclusion grounds
The bidder’s average net turnover must be at least EUR 90,000 in the financial year ending within the last three years before the start of the procurement. The turnover may rely on the bidder, a joint bidder or a subcontractor, but if the bidder relies on another company’s resources, that company’s ESPD must also be submitted. To prove technical capacity, the bidder must have completed at least one similar contract in the last 60 months involving the construction or reconstruction of one borehole with a capacity of at least 10 m3/day. The bid must include the contract description, total amount, currency, performance period, other contracting parties and, where applicable, the procurement reference number. If the reference is based on work performed as a joint bidder, the bidder must explain its own share of the work in percentage terms. The bid must be submitted using the forms required in the procurement documents, including Form 2 Bidder’s confirmations and Form_1_1_Work schedule, and the bidder must confirm bid compliance, equivalence and the submission of bid security.
