The contracting authority will exclude a bidder if the exclusion grounds under Section 95(1) of the Public Procurement Act apply. The same checks are also carried out for any entity whose resources the bidder relies on to prove qualification. If such grounds exist for that entity, the contracting authority applies the rules referred to in Sections 103(6) and 103(6^1). The contracting authority may also exclude a bidder if the exclusion ground under Section 95(4)(8) applies, namely a breach of previous public contracts as described in the referenced provision. The bidder’s net turnover for each of the last two completed financial years before the start of the procurement must have been at least EUR 120,000 per year. If the bidder’s financial year follows the calendar year, the last two completed financial years are 2025 and 2024. The bidder must submit Form 1. The bidder must have properly performed at least one construction contract similar to the subject of the procurement within the 60 months preceding the publication date of the contract notice. A similar contract means a contract under which a new electrical system was built or an existing one was reconstructed. The contracting authority may request a confirmation letter from the client stating that the electrical works were carried out properly. The bidder must submit Form 1 with the bid, containing the information needed to verify qualification. For the performance of the works, the bidder must involve an electrical works project manager. The project manager must have at least a Class B competence certificate or at least the professional certificate “Electrical Engineer Level 6” or equivalent. The bidder must submit Form 4 for this specialist. If the professional certificate or other document proving qualification was issued outside Estonia, the bidder must also submit a document from the competent authority concerned and a document from the competent Estonian authority confirming that the foreign qualification corresponds to the required qualification. The bid must include Form 2, Form 3 and, where applicable, Form 8. If the bid is not a joint bid, Form 8 may be replaced by a clarification that no joint bid is being submitted. The bid must comply with all tender document requirements, include the required price table and, where necessary, evidence of equivalence. If the contracting authority requests product sheets, specifications or other documents for the offered UPS equipment, the bidder must provide them. If the bid contains information subject to access restrictions, the bidder must have submitted the required confirmation protecting that information before submitting the bid.
