Compliance requirements

The bidder must confirm that none of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. The same confirmation must also cover any entity whose resources the bidder relies on for qualification. If exclusion grounds do apply, they must be described in the manner required by the tender documents.

Qualification criteria and exclusion grounds

The bidder must meet the exclusion grounds in Section 95(1) of the Public Procurement Act. The bidder must also confirm that neither the bidder nor any entity whose resources the bidder relies on has those exclusion grounds. Financial capacity: the bidder’s net turnover for each of the last two completed financial years before the start of the procurement must have been at least EUR 60,000. If the financial year follows the calendar year, the relevant years are 2025 and 2024. Technical and professional capacity: the bidder must have performed, as main contractor, at least one supervision services contract in the 36 months before the contract notice was published, on a similar object. A similar object means at least one public building with a closed net area of more than 500 m². The bidder must provide a list of completed and properly performed contracts, including the contract partner’s name and contact details, the object, the building size in square metres of closed net area, the contract period, and, if the contract was awarded through public procurement, the procurement reference number. The bidder must include a responsible supervision specialist with at least the professional qualification “Diplomeeritud ehitusinsener, tase 7”, specialisation “Hoonete ehitus”, competence “Omanikujärelevalve”, or an equivalent qualification. Primary qualifications based only on education are not accepted as equivalent. If the specialist’s certificate was issued in Estonia, the contracting authority will check it in the public professional register and no document needs to be submitted. If the certificate or other proof was issued outside Estonia, the bidder must submit a copy of the relevant document and a document issued by the competent authority of the Republic of Estonia confirming equivalence. If several bidders submit a joint tender, they must appoint a representative and submit a power of attorney and a confirmation of joint and several liability. The tender must also include the required forms: Form 1 for turnover and references, Form 2 for the participation declaration and trade secret list, Form 3 for the price table, Form 4 for the specialist, and Form 8 for joint bidders, if applicable. The tender must comply with all tender documents, and any equivalent solution must be explained and supported by evidence.
