Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members or representatives have been finally convicted during the last five years of, among other things, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, unlawful use of child labour or human trafficking. The bidder must also confirm proper payment of taxes and social security contributions. The bidder must not be bankrupt, in liquidation, subject to insolvency or similar proceedings, or have assets administered by a liquidator or court. There must also be no serious breach of professional conduct, anti-competitive agreement, unresolved conflict of interest, unfair advantage obtained through involvement in preparing the procurement, significant breach of previous contracts, false information or failure to submit required documents. The bidder must additionally confirm that it has not breached applicable environmental, social or labour-law obligations and that neither it nor its representatives have been convicted of enabling an unlawfully residing foreign national to work or of tax offences. The bidder must confirm that entering into the contract would not breach international or Estonian sanctions. Where an exclusion ground exists, evidence of remedial measures restoring reliability may be submitted in certain circumstances, subject to the applicable law and tender documents.

Qualification criteria and exclusion grounds

The machine-readable notice does not specify a separate turnover, previous experience or other financial qualification threshold. To demonstrate tender compliance and technical capacity, the bidder must nevertheless: - confirm that it accepts all conditions set out in the tender documents; conditional tenders are not permitted; - provide the name, position, telephone number and email address of the person who would sign the framework agreement and contract, and of the person who would act as the contract-performance contact, including a power of attorney where necessary; - submit a power of attorney for the authorised representative of joint tenderers where a joint tender is submitted; - confirm that the offered goods are not subject to international sanctions and do not originate from a sanctioned region; - confirm that it will not involve, for more than 10% of the contract value, sanctioned Russian persons, companies or related suppliers or subcontractors in performing the contract; - provide at least one medical technology specialist from delivery of the equipment until the end of the framework agreement, trained by the manufacturer to maintain and repair the offered equipment and able to work in Estonian. The bidder must submit the specialist’s details and the manufacturer’s confirmation of completed training; - include conformity certificates, product catalogues, manufacturer information, user and maintenance manuals, technical data or other documents for the equipment and all accessories to demonstrate compliance; - complete and submit all fields of Annex I, the technical description and tender form; - submit the tender price using Annex II and the required structure. If an equivalent solution is offered instead of a standard, label, manufacturer, origin or other technical basis referred to in the tender documents, the bidder must explain the equivalence and provide supporting evidence.
