Peritoneal dialysis supplies and solutions

Summary

Compliance requirements

The bidder must confirm that neither the company nor its relevant representatives have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or illegal use of child labour or other forms of human trafficking. Exclusion grounds also cover tax or social security payment arrears, bankruptcy, insolvency or liquidation proceedings, suspension of business, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, significant or repeated failures in previous public contracts, submission of false or incomplete information, failure to provide requested documents, and attempts to improperly influence the contracting authority or obtain confidential information. The bidder must also confirm compliance with environmental, social and labour-law obligations, the rules concerning illegally staying foreign workers, international sanctions and other applicable national exclusion grounds. The tax and social security payment threshold stated in the notice is EUR 0. Where an exclusion ground applies, the bidder may provide information on remedial measures restoring its reliability when permitted by the applicable rules.

Qualification criteria and exclusion grounds

The machine-readable notice did not specify precise financial, experience, staffing or other qualification criteria; these must be checked in the official tender documents. The bidder must nevertheless meet the stated compliance requirements: submit a complete and unconditional tender in the required price structure, provide the completed form 1 of Annex 4, and confirm compliance with the tender documents. Where an equivalent product or solution is offered, the bidder must explain the equivalence and provide supporting evidence. The offered goods must not be subject to international sanctions or originate from sanctioned territories. The bidder must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in the Russian Federation, entities more than 50% directly or indirectly owned by them, or entities acting on their behalf or under their instructions. Joint bidders must appoint an authorised representative and submit the required power of attorney. Any claimed trade secret must be described and justified; the tender price and other specified evaluation-related figures may not be designated as trade secrets.
