Compliance requirements

The bidder must confirm that neither it nor its representatives, management or supervisory board members have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. The check also covers persons authorised to represent, make decisions for or control the bidder. Other exclusion grounds include tax or social security payment arrears, bankruptcy or other insolvency proceedings, liquidation, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, material breaches of previous public contracts, and the submission of false information or failure to provide required documents. The bidder must also not have breached environmental, social or labour-law obligations. The bidder must confirm that entering into the contract would not breach international or Estonian sanctions and that the goods are not of a sanctioned origin. During contract performance, the bidder may not use Russian citizens, residents or entities established in Russia, or entities controlled by them, as suppliers or subcontractors for more than 10% of the contract value. If an exclusion ground exists, the contracting authority may request additional explanations and evidence.

Qualification criteria and exclusion grounds

The machine-readable ESPD does not specify separate turnover, previous experience, staffing or professional qualification requirements. The bidder must submit a compliant tender and, for each offered lot, complete all blue-marked fields in Annex 3, the product specification and price form. The offered goods must meet the requirements of the technical description in Annex 1. Where the offered goods differ from a referenced standard, label or other technical basis, the bidder must provide an explanation of equivalence and supporting evidence. The tender must remain valid for four months. The bidder must provide details of the contract signatory, contract contact and ordering contacts; a power of attorney must be attached if the contract is signed by an authorised representative. In a joint tender, a power of attorney for the joint bidders must be included. Bids may be submitted for all four lots, and a contract may be awarded to one bidder for up to four lots.
