The bidder must confirm that neither it nor its administrative, management or supervisory body members, procurists, or other persons authorised to represent, control or make decisions on its behalf have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism or terrorism-related offences, money laundering or terrorist financing, or the illegal employment of children or offences related to human trafficking. If such a ground applies, the bidder must provide the relevant details and, where applicable, describe the measures taken to restore its reliability; such remedial measures may be considered only where permitted by law or provided for in the tender documents. The bidder must not have outstanding taxes or social security contributions in Estonia or any other relevant country. If an obligation has been breached, the bidder must provide the required information and evidence, including information on payment of the obligations or a binding repayment agreement. The bidder must also not have breached obligations concerning the employment of a foreign national staying without a legal basis or the employment conditions of a foreign national in Estonia, and must not be subject to an international or Estonian sanction that would make the contract award unlawful. The bidder must confirm that it is entitled to submit a tender and that its place of establishment or residence does not breach any participation restriction set out in the tender documents. For the verification of exclusion grounds, the bidder must provide the names and personal identification codes of persons authorised to control the company who are not visible in the Commercial Register, or confirm that no such persons exist. In a joint tender, a power of attorney for the joint tenderers must be submitted. The bidder must identify any trade secrets and justify their protection; the tender price and other prohibited numerical indicators may not be designated as trade secrets.

The bidder must have completed at least three separate contracts during the 36 months preceding the start of the procurement. At least one contract must cover the methodological creation or updating of e-learning content, at least one must cover the technical implementation of e-learning or the conversion of learning materials into a format suitable for a digital learning environment, and at least one must demonstrate experience in delivering a broader e-learning development task, such as solving an organisational, process, guidance-material or learning-pathway challenge. For each contract, the bidder must provide the contract details, value, dates, other contracting party and an explanation of which requirement it demonstrates; where the contract resulted from a public procurement, the procurement reference must also be provided. The contracting authority may verify the information with the other contracting party or through public databases. If the bidder relies on the resources of other entities, it must also submit a procurement passport for each such entity. The bidder must provide at least the following core team: a responsible project manager or service manager with at least five years of experience managing similar e-learning, digital service, digital learning solution, or training and development projects; an instructional designer or methodological lead with at least three years of relevant experience and experience creating or updating e-learning courses, learning pathways or digital learning content; an e-learning technical developer or educational technologist with experience in technical e-learning implementation, digital learning content development, using at least one e-learning authoring tool or equivalent, and packaging learning materials in a format suitable for a learning environment; and a videographer with experience planning, filming, editing and preparing educational or instructional videos for publication. One team member may perform several roles if the person meets the requirements for each role and the organisation of the work allows the service to be delivered properly. The bidder must also provide, as needed, expertise in multimedia production and processing, language editing and translation, accessibility, user experience, service design, testing and subject-matter expertise. The tender must include a description of the team and work organisation, including roles, responsibilities and cooperation partners. The successful bidder must submit evidence of team members’ qualifications and previous experience within 10 days after contract signature. The bidder must submit a description of substantive quality and the service delivery methodology, as well as a description of strategic partnership and cooperation with stakeholders. The descriptions must cover all topics required in sections 7.1 and 7.2 of the technical specification and explain cooperation with the contracting authority, client institutions, subject-matter experts, learner representatives and other relevant stakeholders. If any required part is missing, the tender will be deemed non-compliant and rejected. The bidder must also confirm compliance with the tender documents; conditional tenders are not permitted. In a joint tender, a power of attorney for the joint tenderers must be submitted. During contract performance, only subcontractors and suppliers established in the required countries may be used. Under the environmental requirements, materials must generally be delivered digitally, files must be stored and transmitted in an optimised size, unnecessary files must be deleted as soon as possible, and products bearing a Type I ecolabel should be preferred when printing is necessary.
