Compliance requirements

The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been initiated against it, if its business is suspended, or if it is in a similar situation under the law of its country of establishment. The bidder is also excluded if it has tax, fee or environmental charge arrears, or tax or social security contribution arrears, unless the debt has been deferred, paid, or will be paid or deferred within 10 calendar days after receiving notice of the exclusion ground. The bidder must also confirm that the exclusion grounds listed in section 95(1) points 1–3 and 5 of the Public Procurement Act do not apply, that its average employee salary was not below 70% of the average salary in the relevant sector during the reference period, and that it is not a related person to the technical consultant advising on the apartment building reconstruction. If the required evidence is not submitted and the contracting authority cannot verify the absence of exclusion grounds from public registers, the bidder must provide the documents within 10 calendar days.

Qualification criteria and exclusion grounds

The bidder must have the relevant registration in the business register for construction activities covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering construction, including installation, of electrical installations. Foreign bidders are exempt from the registration requirement but must provide equivalent proof. The bidder’s team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and the person performing electrical works; each role has a specific professional qualification or competence requirement. The bidder must prove that within the last 60 months it has carried out at least one equivalent construction project worth at least half of the contract’s estimated value excluding VAT. The equivalent project must have been the construction, extension, or full reconstruction of a building as the main contractor and must have included at least load-bearing structures and external envelope works, heat-recovery mechanical ventilation, and construction or reconstruction of the heating system. The bidder’s previous financial year net turnover must be at least equal to twice the estimated contract value excluding VAT. By the contract signing date, the bidder must be able to provide a 5% performance security for the construction period. If evidence is not submitted with the bid and the contracting authority cannot verify compliance from public registers, the bidder may be given 10 calendar days to submit the documents.
