Compliance requirements
The bidder must confirm that neither the bidder nor persons involved in its management, representation or control have been finally convicted within the last five years of, among other things, participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour or trafficking in human beings. The exclusion grounds also cover failures to pay taxes or social security contributions, bankruptcy or insolvency and liquidation proceedings, agreements with creditors, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious breaches of previous contracts, and the submission of false information or failure to provide required documents. Compliance with environmental, social and labour law obligations, rules concerning the employment of illegally staying foreign nationals, tax-related offences and international sanctions is also checked. Where applicable, a bidder may provide evidence of remedial measures demonstrating restored reliability. The required declarations and, where necessary, evidence must be provided in the ESPD and checked against the tender documents.
Qualification criteria and exclusion grounds
The machine-readable notice does not specify separate turnover, previous experience, staffing or other numerical selection requirements for bidders. However, the bidder must submit a compliant and unconditional tender, the completed participation application, the price form and the technical description tender form. The tender must include a list of the offered device, accessories, software, licences and other important components, together with a detailed technical description and manufacturer-issued technical documentation in Estonian or English, such as manuals, data sheets, safety data sheets, registration certificates, certificates or other evidence enabling the contracting authority to verify compliance. The bidder must also provide the manufacturer’s specified regular maintenance frequency, the work performed during maintenance and the required time, as well as a list and prices of replacement maintenance supplies, spare parts and consumables. A manufacturer-issued document or copy must prove that the bidder is an official representative or authorised reseller of the offered products. In a joint tender, a power of attorney for the joint bidders must be included. If an equivalent product or solution is offered, its equivalence must be explained and supported by evidence. The tender price must follow the required structure; in the event of a discrepancy, the amounts in the price form will prevail. The tender may not contain conditional deviations. The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned territories, and that it will not use subcontractors or suppliers accounting for more than 10% of the contract value who are Russian citizens, residents, entities established in Russia or entities controlled by such persons.
