Compliance requirements
A bidder will be excluded if it is bankrupt, being wound up, subject to bankruptcy or liquidation proceedings, has suspended its business activity, or is otherwise in a similar situation. The bidder must not have outstanding state tax, payment, environmental charge, tax or social security contribution debts, unless the debt has been paid or deferred, or is paid or deferred within 10 calendar days after receiving notice of the ground for exclusion. The bidder must confirm that none of the exclusion grounds referred to in section 95(1), points 1–3 and 5, of the Public Procurement Act apply, and must demonstrate that the average employee remuneration during the six-month reference period was not below 70% of the average remuneration in the relevant field. This remuneration requirement does not apply where the bidder has no employees. A foreign bidder must provide evidence from an equivalent competent authority in its country of establishment. The bidder must not be a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. Tax and remuneration data will be checked through registers; if this is not possible, the contracting entity may request certificates issued no more than two weeks before the tender submission deadline. The bidder will be given 10 calendar days to submit missing evidence, and failure to do so results in exclusion.
Qualification criteria and exclusion grounds
The bidder must be registered in the Estonian Register of Economic Activities for construction activities covering general construction, indoor climate systems, and water supply and sewerage systems inside or connected to a building. Where electrical works are performed, the registration must cover construction and installation of electrical installations. Foreign bidders may provide equivalent evidence of competence instead of an Estonian registration.
The bidder’s net turnover in the financial year preceding submission of the tender must be at least twice the estimated contract value excluding VAT; the turnover must be stated to the nearest euro.
The bidder must be able to provide, no later than the date of signing the construction contract, an on-demand guarantee issued by a credit or financial institution or an insurance company in the amount of 5% of the construction contract value excluding VAT. If the contract is signed before the guarantee is provided, it must be submitted within 10 calendar days after signing and remain valid throughout the construction period. Depositing an equivalent amount with the beneficiary or a notary is also acceptable.
During the 60 months preceding the start of the procurement, the bidder must have completed at least one comparable construction project as the main contractor, with a value of at least half the estimated contract value. The project must have involved construction, extension or full-building reconstruction and must have included construction or reconstruction of the building’s load-bearing structures and external envelope, heat-recovery mechanical ventilation, and a new heating system. The bidder must provide the project details, execution period and value, together with either the relevant building register notice of use or occupancy permit number, or a handover and acceptance certificate signed by the client and contractor.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and electrical works specialist with the required qualifications. The project manager must hold at least a level 6 building engineer qualification specialised in building construction, or an equivalent level 6 construction manager qualification. The site manager must hold at least a level 5 construction works manager qualification. The ventilation and heating systems specialist must hold at least a relevant level 6 heating, ventilation and refrigeration engineer qualification or an equivalent level 6 construction manager qualification. The water supply and sewerage specialist must hold at least a relevant level 6 engineering qualification or an equivalent level 6 construction manager qualification. The electrical works specialist must hold at least a Class B certificate of competence or a level 6 electrical engineer qualification in consumer electrical installations. The name and certificate number of each specialist must be provided. Where the bidder relies on another person’s capacities, signed confirmations of participation must be submitted.
A level 7 authorised architect, or a person with equivalent foreign qualifications, must be responsible for ensuring that the building design complies with the requirements of the New European Bauhaus. The bidder must have a quality management system in the construction field meeting ISO 9001 or equivalent requirements, and an environmental management system meeting ISO 14001 or equivalent requirements. Evidence issued by independent bodies must be provided.
The tender must include the completed tender form and pricing information in the required structure. The sum of the partial prices and unit prices must equal the amount submitted under the published award criteria. In a joint tender, a power of attorney for the joint tenderers must be included. By submitting the tender, the bidder confirms acceptance of all tender document conditions; conditional tenders are not permitted.
