Compliance requirements

The bidder must confirm that neither the company nor its representatives are subject to exclusion grounds, including final convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also confirm compliance with tax and social security payment obligations and disclose any relevant arrears. Other exclusion grounds cover insolvency, bankruptcy, liquidation, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or persistent breaches of previous public contracts, false or misleading information, failure to provide required information or documents, and breaches of environmental, social or labour law obligations. The bidder must also confirm that entering into the contract would not breach international or national sanctions and that no relevant convictions for unlawful employment of foreign nationals or tax offences apply. Where an exclusion ground exists, evidence of remedial measures may be submitted where legally permitted.

Qualification criteria and exclusion grounds

The machine-readable notice does not specify financial turnover, previous experience, personnel, professional registration or other separate qualification thresholds. The bidder must nevertheless meet the compliance requirements and submit the required evidence. A complete tender must include the completed technical description and price form, the required price structure, manufacturer specifications proving compliance with the technical description, and any evidence of equivalence where an equivalent product or standard is offered. The bidder must provide compliant life-jacket samples for the relevant lot or lots before the tender deadline. Samples must be delivered to Pärnu mnt 139, Tallinn, in sealed opaque packaging that prevents opening or damage during normal handling. The samples and their packaging must not reveal the bidder, manufacturer or product origin; the outer packaging must contain the specified bidder, contact and procurement identification details. Late or missing samples, or samples that fail the technical requirements, lead to rejection of the tender. The bidder must state a delivery period in whole calendar months, which may not exceed 4 months from receipt of an order, and must include delivery to the contracting authority’s location in Estonia in the tender price. The minimum order is one life jacket. A warranty of at least 1 year from handover is required for both products. The bidder must also be capable of adding textile fasteners and radio equipment mounts during contract performance. For a joint tender, an authorisation of the joint bidders’ representative must be submitted. The bidder must identify the contract signatory and contact person and declare any business secrets with reasons; the tender price and other legally non-confidential evaluation figures may not be classified as business secrets.
