The bidder must not be subject to any exclusion grounds set out in Section 95(1), points 1–5, or Section 95(4), point 12, of the Public Procurement Act, and must confirm their absence in the public procurement register. If persons who are not shown on the commercial register card are authorised to represent, control or make decisions for the company, their names and personal identification codes must be provided, or the bidder must confirm that no such persons exist. If the tender is submitted by a branch of a foreign company, evidence that the exclusion grounds do not apply must be provided for the foreign company and the relevant management, supervisory and authorised representatives. A subcontractor must confirm on Form 5 that no exclusion grounds specified in the tender documents apply to it.

The bidder must be registered with the Financial Supervision Authority as an active insurance broker; a branch of a foreign company must be registered as an active branch of a foreign insurance broker. There must be no restrictions on operating as an insurance broker, and for service contracts the bidder may not rely on other persons for the required licences or registrations. The bidder must hold compulsory professional liability insurance complying with Section 179 of the Insurance Activities Act and must submit the insurance policy as evidence. During the 36 months preceding publication of the contract notice, the bidder must have completed at least two insurance consultancy service contracts, each worth at least EUR 7,000 excluding VAT. A list of the contracts must be submitted using Form 7, including their value, signing dates, client name and contact details, and the procurement reference number where applicable. If the bidder relies on another entity’s experience, it must submit the consent required by Form 8, identify the subcontractor and describe its participation in contract performance. The tender must include an unconditional confirmation that the tender documents’ conditions are accepted, the price in the required structure, a description of the service prepared in accordance with the technical description, the responsible person’s CV using Form 3 and the client confirmation using Form 4. During the five years preceding publication of the contract notice, the responsible person must have at least three years, or 36 months, of relevant insurance intermediation experience in total, including advising on the procurement and terms of liability, property and directors’ and officers’ liability insurance, preparing and arranging insurance contracts, and representing clients in claims-handling processes. The CV must be signed by both the responsible person and the bidder’s representative. If the responsible person is a subcontractor, the bidder must also submit the signed participation confirmation required by Form 5.
