Compliance requirements

The bidder must confirm that neither it nor its administrative, management or supervisory body members or representatives have, during the last five years, been convicted by a final judgment of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal employment of children or human trafficking. The bidder must also have complied with its tax and social security payment obligations; the ESPD states a tax-debt threshold of EUR 0, subject to the tax authority’s clarification that a certificate is not issued where the debt is below EUR 100 or payment has been deferred. The exclusion grounds also cover bankruptcy, liquidation or other insolvency proceedings, an agreement with creditors, assets being administered by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, material breach or early termination of a previous public contract, and the submission of false information or failure to provide required documents. Breaches of environmental, social or labour-law obligations may also lead to exclusion. The bidder must confirm that awarding the contract would not breach international or Estonian sanctions and that the offered goods are not subject to sanctions and do not originate from sanctioned regions. During contract performance, the bidder may not involve subcontractors or suppliers representing more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, entities directly or indirectly more than 50% owned by such persons or entities, or representatives of or entities acting on their instructions. Where the tender documents allow it, the bidder may submit evidence of remedial measures demonstrating restored reliability if an exclusion ground applies.

Qualification criteria and exclusion grounds

The machine-readable ESPD does not specify concrete requirements concerning turnover, previous experience, team members or professional certificates. The bidder must nevertheless submit the ESPD and comply with the compliance requirements. The bid must include a completed tender submission form and any supporting materials referred to by the bidder to prove the products’ characteristics and compliance with the requirements. The bid must comply with the tender documents; conditional bids are not permitted. Where an equivalent product or solution is offered, the bidder must provide an explanation of equivalence and supporting evidence where necessary. In the case of a joint bid, a power of attorney for the joint bidders must be included. Bids may be submitted for up to six lots, and contracts may be awarded to one bidder for up to six lots.
