Maintenance services for the computer applications of the Spanish Patent and Trademark Office

Summary

The contract covers incident management and corrective, adaptive and evolutionary maintenance of the Spanish Patent and Trademark Office’s (OEPM) IT applications. The work supports electronic and paper application intake, industrial property proceedings and records, financial and administrative systems, publication and search applications, international cooperation, document management, data repositories and business intelligence. It is divided into four lots: digitisation and case-processing applications; publication, consultation and international-cooperation applications; electronic applications and financial and administrative systems; and document management, data repositories and business intelligence. Lot 1 uses both a managed-service model and a turnkey-project model. The initial term is 24 months and 21 days, with a planned start date of 6 February 2027; the service take-over phase lasts up to 21 days and the handover phase up to 30 calendar days at the end of the contract. The contract may be extended in annual periods for up to two additional years. The total budget is €10,813,491.15 including VAT: Lot 1 €4,108,829.05, Lot 2 €2,718,438.49, Lot 3 €2,977,497.55 and Lot 4 €1,008,726.06. Services will be performed mainly remotely and from the contractor’s offices during OEPM working hours. Spanish is mandatory; the project manager, analysts or, if required by OEPM, the whole team may need to attend the premises for certain tasks. Bidders must provide evidence of the required financial and technical capacity, undertake to assign the necessary personnel and demonstrate the required quality-management and agile-development capabilities. The bid must include a price proposal and a technical solution with service take-over, delivery and handover plans. Price accounts for 51% of the award assessment, additional services 6% and qualitative bid quality 43%; at least 23 points on the technical criteria are required to proceed to automatic-criteria assessment. Bids must be submitted electronically. A company may be awarded no more than two lots and must observe the restrictions on combinations of lots.
