Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if it or a person authorised to represent, direct or control it has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies to convictions relating to enabling the illegal employment of foreign nationals or breaches of their employment conditions, including payment below the legally required wage, as well as illegal use of child labour or human trafficking. A bidder with outstanding national taxes, duties or environmental charges, or tax or social security contributions due under the law of its country of establishment, will be excluded. The contract must not be awarded where doing so would breach an international or Estonian government sanction. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder or its subcontractor must have completed at least one contract similar to the subject of the procurement during the 60 months preceding the start of the procurement. The bidder must provide a list of its most important completed works, stating their value, dates and the other contracting parties. If relying on a subcontractor’s experience, the bidder must identify that subcontractor in the subcontractor table. The works must be overseen by a qualified responsible person who is a certified construction engineer at level 6 or an equivalent or higher level. The bidder must provide a list of the responsible persons and copies of documents proving their qualifications and competence. If a subcontractor is used, its confirmation of consent to perform the subcontracted work must be submitted. A foreign bidder whose responsible person’s qualification documents were not issued under Estonian regulations must provide copies of documents issued under the laws of its country of establishment and confirm that it will provide the Consumer Protection and Technical Regulatory Authority’s confirmation of that person’s qualifications within one month after signing the contract. The bid must comply with the procurement documents; conditional bids are not permitted. A completed price form must be submitted in the structure specified in the procurement documents. The bidder must disclose circumstances that may give rise to a conflict of interest or a competitive advantage and, where applicable, provide a description and relevant explanations. The machine-readable notice does not specify detailed award criteria.
