Compliance requirements
The exclusion grounds cover final convictions within the previous five years, or an exclusion period still in force, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. They also cover breaches of tax or social security payment obligations; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements, administration of assets or suspension of business; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot otherwise be avoided; involvement in preparing the procurement where an advantage and resulting distortion cannot otherwise be remedied; significant or persistent failures under previous contracts resulting in early termination, damages, price reduction or penalties; false or misleading information, withholding information, failure to submit requested supporting documents, or attempts to obtain confidential information or improperly influence the procedure. National grounds also include enabling a foreign national to work unlawfully or in breach of employment conditions, being subject to applicable international or Estonian sanctions, and convictions for tax offences. Where a ground applies, the tenderer may provide evidence of measures taken to restore its reliability where permitted. Tax and social contribution debt below EUR 100 may not result in issuance of a tax-debt certificate under the stated Estonian rules, and payment arrangements are also noted.
Qualification criteria and exclusion grounds
The procurement is divided into three lots: Järve, Kohtla-Nõmme and Toila-Voka. The tenderer’s aggregate net turnover for the last three completed financial years (2023–2025) must be at least EUR 490,000 for Järve, EUR 694,000 for Kohtla-Nõmme and EUR 852,000 for Toila-Voka. The threshold applies to the relevant lot.
For all lots, the person responsible for the maintenance work must hold a road engineer professional qualification at level 6 or higher, specialising in road construction and maintenance or roads, with competence in managing construction activities or maintenance. This person must participate directly in contract performance and provide a signed confirmation in free form.
The tenderer must confirm that it has the technical capability to carry out road and street maintenance and submit Form 4 confirming the availability of equipment. The bid must include the bill of quantities using the form in Annex 6 to the procurement documents and a EUR 2,000 tender guarantee, valid for the same period as the bid. The guarantee may be provided by a credit, financing or insurance institution, or by depositing the amount into the contracting authority’s bank account.
The bid must comply with the tender documents and follow the prescribed pricing structure; conditional bids are not permitted. Where equivalence is relied upon, it must be explained and supported with evidence. In a joint bid, the tenderers must appoint an authorised representative and provide the power of attorney and the required confirmation from each joint tenderer. The bid must be submitted by a person with authority to represent the tenderer or an authorised representative. The tenderer must identify and justify any trade secrets; the bid price and figures used for evaluation may not be designated as trade secrets. Detailed award criteria are not available in the extracted text and should be checked in the tender documents.
