Compliance requirements
The bidder may be excluded for relevant convictions within the previous five years involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, an arrangement with creditors or suspended business activity; serious professional misconduct; competition-distorting agreements; unmanageable conflicts of interest or involvement in preparing the procurement; and serious or repeated breaches of previous contracts resulting in early termination, damages or comparable sanctions.
Grounds also include breaches of environmental, social or labour-law obligations; false or misleading information, failure to provide required information or requested documents, or attempts to obtain confidential information improperly; enabling the unlawful employment of a foreign national, including paying less than the statutory wage rate (mandatory ground); and, where applicable, being subject to international sanctions or having been convicted of tax offences. For certain grounds, the bidder may provide evidence of measures taken to restore its reliability where the law or tender documents allow this.
Qualification criteria and exclusion grounds
The bidder must submit a technical description of the offered product containing all information required by the tender documents. The submission must also identify the product and include its specifications, product sheets and any other information needed to verify compliance. The bid must comply with the tender documents; conditional bids are not permitted. For a joint bid, an authorisation appointing a representative for the joint bidders must be included. The bidder must identify and justify any information claimed as a trade secret; the bid price and figures used in evaluation may not be classified as trade secrets. If the bidder has authorised persons who are not identifiable from the commercial register or an equivalent extract, it must provide their names and personal identification numbers or dates of birth, or confirm that there are no such persons.
The bidder must confirm that it is not established or resident in Russia or Belarus and that the offered goods are not subject to international sanctions and do not originate in a sanctioned region. It must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act on their behalf or under their direction.
No specific financial or previous-experience qualification thresholds or award criteria are stated in the available notice; technical details must be checked in the tender documents.
