Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder will be excluded if the bidder, or a person authorised to represent, manage or control it, has been convicted of the serious criminal offences listed in section 95(1) of Estonia’s Public Procurement Act. These include participation in a criminal organisation, breach of integrity or corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals, and offences involving child labour or human trafficking. Exclusion also applies where the bidder has outstanding taxes, duties or environmental charges, or where awarding the contract would breach an international or Estonian government sanction. Participation is restricted to businesses established in Estonia, another EU Member State, an EEA contracting state or a state party to the WTO Government Procurement Agreement. Businesses established in Russia or Belarus may not participate. The tender documents also require confirmation that the bidder will not use, for more than 10% of the contract value, subcontractors or suppliers who are Russian nationals, residents or entities established in Russia, entities more than 50% owned by such persons or entities, or persons acting on their behalf or instructions. A bid may be rejected if awarding the contract would be prohibited under the applicable sanctions rules.

Qualification criteria and exclusion grounds

The bidder’s aggregate net turnover for the last three financial years completed by the start of the procurement must be at least EUR 900,000. The contracting authority will check publicly available records. If relevant information cannot be obtained from those records without significant effort, the bidder must provide further explanations, data or documents when requested and by the deadline set by the contracting authority. The successful bidder must maintain professional indemnity insurance throughout the contract, with cover of at least EUR 100,000. The bidder must provide a copy of the policy or confirm that the required insurance will be taken out and a copy provided no later than two weeks after the contract takes effect. The bidder must identify at least one contract completed during the three years before publication of the contract notice in which it used cleaning products bearing the EU Ecolabel for hard-surface cleaning products or another officially recognised Type I ecolabel under EN ISO 14024. The bidder must provide a description of the contract, the cleaning products used and the client’s contact details. The bidder must hold a valid Estonian Association of Real Estate Maintenance certificate for property upkeep at class *** or higher, or a comprehensive maintenance-services certificate at class *** or higher. If it holds neither, it must have a valid ISO 9001 certificate covering property, buildings and structures maintenance, including maintenance and repair work, or an equivalent certificate or competence. A copy of the certificate must be provided. The bid must identify a site-specific supervisor who can be reached at the sites when operationally needed by the contracting authority, has experience delivering similar upkeep services and holds at least a level 4 Cleaning Services Supervisor vocational qualification or an equivalent qualification. The bidder must provide an extract from the supervisor’s CV describing relevant experience and a copy of the qualification certificate or equivalent evidence. The team must include a service manager competent to carry out quality inspections under EVS 914 (INSTA 800), with knowledge level 3 or higher or equivalent competence. The bidder must provide a copy of the certificate, or confirm that the manager will obtain it within three months after contract award and provide a copy to the contracting authority. The bid must comply with the procurement documents; conditional bids are not permitted. Any proposed equivalence must be explained and supported by evidence where required. The bidder must complete the price schedules for the Auvere and Narva industrial territories and transfer the resulting total to the bid price form. Before the service starts, the bidder must train the cleaning staff on the correct dilution and dosing of cleaning agents, wastewater disposal and waste sorting. Evidence of the training must state its date, trainer, participants and topics. During the contract, the bidder must monitor and record the stated performance indicators for at least one full working day every four months. Records must cover quantities of cleaning products, their ecolabel status and dilution rates; types and reusability of cleaning equipment; water used and its disposal point; and the amount and sorting of solid waste. Products must be used according to their instructions; where possible, EU Ecolabel or equivalent Type I ecolabel products must be used. The bidder must minimise disposable cleaning materials, use water efficiently, reduce solid waste and sort waste. The monitoring procedure and related confirmation are not required if the bidder has an ISO 14001-certified or EMAS-registered environmental management system, or an ecolabel for indoor cleaning services meeting the stated requirements. In that case, evidence of the relevant system or ecolabel must be provided. All cleaning products must meet criteria 1 and 4 of the EU Ecolabel criteria for hard-surface cleaning products. The bidder must provide a list of products and evidence of compliance: an ecolabel certificate for EU Ecolabel products, or an audit by a conformity assessment body or independent auditor for products without that label. Handwashing soap must meet the EU Ecolabel requirements for rinse-off cosmetics. A list of soaps and evidence must be provided, either an ecolabel certificate or, if there is no ecolabel, an audit by a conformity assessment body or independent auditor. The supplied document text does not specify the award criteria or their weighting; these should be checked in the procurement documents.
