Compliance requirements
The bidder may be excluded if the bidder or a person in its management, supervisory body or authorised representation has a final conviction within the last five years, or an exclusion period remains in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also cover breaches of tax or social security payment obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; agreements or conduct distorting competition; an unmanageable conflict of interest; involvement in preparing this procurement where an unfair advantage cannot otherwise be prevented; and significant or repeated breaches of previous contracts resulting in early termination, damages, a price reduction or penalties.
Other grounds include breaches of environmental, social or employment-law obligations; enabling a foreign national to work without a legal basis or in breach of applicable employment conditions; being subject to international sanctions; tax-related criminal convictions; and being barred under the procurement rules from submitting an offer because of the bidder's place of establishment. A bidder may also be excluded for false or misleading information, withholding required information, failing to provide requested supporting documents promptly, or improperly seeking confidential information or influencing the contracting authority. Where legally available for this procurement, the bidder may provide evidence of remedial measures to demonstrate reliability.
For tax and social security debts, the notice sets a zero-euro threshold; the stated national-law rules also provide that a tax debt certificate is not issued for debts below EUR 100 or where payment has been rescheduled.
Qualification criteria and exclusion grounds
For all 37 lots, the bidder must be entered in the business register of its country of establishment if registration is required there. Submit a copy of a valid registration certificate; if the bidder is not required to register, submit its articles of association or an equivalent document. The contracting authority will check the details of Estonian companies in the business register.
For all 37 lots, the bidder must hold a licence to wholesale medicinal products in Estonia. The bidder must confirm that the licence is held; the contracting authority will check it in the Medicines Agency register.
The bid must include the required declaration form and a description enabling the contracting authority to verify compliance with the tender documents and technical specification. The bid must remain valid for at least 3 months. If the signatory is not registered as having authority to represent the bidder, include a power of attorney. Joint bidders must appoint an authorised representative and submit the original power of attorney granted to that representative.
The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. Each offered medicine must have a marketing authorisation issued by the Estonian Medicines Agency or the European Commission, or an import or use authorisation issued by the Estonian Medicines Agency. If the authorisation cannot be checked in the register, provide the relevant evidence or a copy of the authorisation document.
For each lot, the Appendix 1 form must state the name, manufacturer and prices of every offered product, with all fields for that lot completed. Unit prices must include all delivery costs to the Pärnu Hospital pharmacy at Ristiku 1, Pärnu, and the total for each lot entered in the electronic system must match the total in the price form. Prices must follow the prescribed structure. Only one bid may be submitted per lot; variants, alternatives, partial and conditional bids are not accepted. Any information identified as a trade secret must be justified, but bid prices, lot prices and indicators used for evaluation may not be designated as trade secrets. The supplied text does not describe a separate scored award criterion.
