Compliance requirements
The bidder may be excluded if it or a member of its administrative, management or supervisory bodies, or a person authorised to represent, decide for or control it, has relevant convictions within the previous five years or remains subject to an exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Exclusion may also apply for unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; competition-distorting agreements; conflicts of interest that cannot otherwise be remedied; involvement in preparing this procurement that creates an unremediable competitive advantage; serious or repeated breaches of prior contracts resulting in early termination, damages or comparable penalties; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procedure; and breaches of environmental, social or labour obligations. National grounds also include enabling the unlawful employment of a foreign national, being subject to applicable international sanctions, and relevant tax-crime convictions. The notice states that the tax-debt threshold is EUR 0, while noting that an Estonian tax-debt certificate is not issued for debt below EUR 100 (excluding interest not established by an administrative act) or where payment has been deferred. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
