Compliance requirements
A bidder may be excluded if it, or a member of its management, administrative or supervisory body or an authorised representative, has a final conviction within the previous five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion may also apply for breaches of tax or social security payment obligations; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, an agreement with creditors, a similar national procedure, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unavoidable conflict of interest; or involvement in preparing the procurement that creates an advantage which cannot otherwise be remedied. Other grounds include serious or repeated failures under previous contracts resulting in early termination, damages, price reduction or penalties, and false or misleading information, withholding information, failure to provide requested supporting documents, or improper attempts to obtain confidential information or influence the procurement decision.
A bidder may also be excluded for enabling a foreign national without a lawful basis to work, violating rules on foreign nationals’ working conditions or pay, being subject to an international sanction, or having a relevant tax offence conviction. The tax-related grounds cover the bidder’s country of establishment and the contracting authority’s country, where different. The notice sets a zero-euro threshold; the stated clarification notes that a tax-debt certificate is not issued where the debt is under EUR 100 or payment has been rescheduled. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.

Lots 2–14 also require seasonal tyre storage in accordance with the technical specification. Prices must be submitted in the prescribed format, and conditional tenders are not permitted. The bidder must confirm compliance with the tender documents and, where relevant, explain equivalence and provide supporting evidence. For a joint tender, the participants must appoint an authorised representative and include an authorisation. The bidder must identify and justify any information claimed as a trade secret; tender prices and numerical figures used for evaluation may not be classified as trade secrets.
