Compliance requirements
A bidder may be excluded if the bidder or a person in its management, supervisory or control bodies, or authorised to represent or control it, has a relevant final criminal conviction within the previous five years or remains subject to an exclusion period. The specified offences include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. The grounds also cover unpaid taxes or social security contributions, an unmanageable conflict of interest, and serious or repeated breaches of previous contracts resulting in early termination, damages, price reductions or penalties. A mandatory ground applies to convictions for enabling the unlawful employment of a foreign national. A contract may not be awarded where this would breach international or Estonian sanctions; the contracting authority may request supporting information if there is reasonable doubt. Where legally permitted, a bidder may submit evidence of measures taken to restore its reliability.
