Compliance requirements

The bidder and persons with powers of management or representation must not have been convicted by a final judgment within the previous five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, unlawful use of child labour, or human trafficking. Grounds for exclusion may also include failure to pay taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, liquidation or another insolvency situation; suspended business activities; serious professional misconduct; anti-competitive agreements; an unresolved conflict of interest; an unfair advantage arising from involvement in preparing the procurement; serious or repeated breach of a previous contract; and misrepresentation or failure to provide required information. The grounds also cover facilitating the employment of a foreign national staying in the country unlawfully, international sanctions and tax offences. The bidder must confirm that it will not involve, for more than 10% of the contract value, Russian nationals, residents or entities established in Russia, or entities more than 50% owned by them or acting on their instructions. The goods offered must not be subject to international sanctions or originate in a sanctioned region. The bidder must also confirm that it will not use a subcontractor subject to replacement because of an exclusion ground. First-tier subcontractors will be checked during contract performance.

Qualification criteria and exclusion grounds

The bidder’s total net turnover over the last three financial years completed by the start of the procurement must be at least EUR 200,000. The bidder must report the turnover for those years in the ESPD. The contracting authority may request the annual accounts or extracts if they are not available in a public database. During the five years before publication of the contract notice, the bidder must have completed at least one construction contract as the main contractor, with construction works worth at least EUR 100,000 excluding VAT. The main contractor must have been responsible for the overall organisation and management of the works and coordination of the different trades. The reference must concern a care institution, dormitory, accommodation, catering, office, retail, service or entertainment building, museum or library, education or research building, hospital, or sports building. The ESPD must include the contract description, value, completion dates, client and contact-person details, and building type. The contracting authority may request further evidence. The bidder must submit a duly completed specialists’ table signed by the specialists and confirm that it can provide design specialists meeting the competence requirements in section 3.2 of the technical description and construction and reconstruction specialists meeting those in section 3.3. The precise competence requirements must be checked in the technical description. The tender must comply with the procurement documents. Any equivalent solution must be explained and supported by evidence. Conditional tenders are not permitted. The tender price must follow the required structure and include a properly completed price table. The bidder must submit a table of subcontractors known at the time of tendering; the table may be empty if there are none. For a joint tender, an authorisation appointing the joint tenderers’ representative must be included. The bidder must visit the site at Raja tn 4c, Tallinn, before submitting its tender and confirm the visit in writing. Registration is required at least three working days in advance and must identify the company and participants. Participants must bring identification and sign the attendance sheet. A tender will be rejected if the bidder has not visited the site. For appointment to the framework, the lowest-priced tender for the first site is used; the framework will be concluded with up to ten bidders submitting compliant tenders, and at least two.
