Compliance requirements

The bidder must confirm that neither the company nor its management, supervisory board members, procurist or other authorised representatives have been convicted of offences such as participation in a criminal organisation, breach of duty of integrity, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, illegal employment of foreign nationals, unlawful employment of children or human trafficking. The bidder must also have no outstanding state tax, payment or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may additionally exclude a bidder that has seriously or repeatedly breached an earlier public contract, or has provided false information or failed to submit required information or documents. Companies established or residing in the Russian Federation or Belarus may not participate. The bidder must provide the relevant confirmations and evidence if requested.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one of these contracts must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party's representative and contact details, and procurement reference numbers where applicable. Evidence of proper performance must be provided upon request unless the contracting authority can obtain it from databases without disproportionate cost. The bidder must have a person with valid switching rights for work-related switching operations in the 0.22–20 kV electricity network. The person must be registered in the Elektrilevi Partner Portal before bids are opened. For low-voltage works only, at least low-voltage switching rights are required; in other cases both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side. The bidder must also have a person responsible for the work operation with valid rights, registered in the Partner Portal before bids are opened. The bidder must have a person managing electrical works who holds valid A-competence and/or a qualification corresponding to at least level 6 under the Estonian Qualifications Act, with the relevant evidence available when bids are submitted and the person registered in the Partner Portal before bids are opened. The bid must be unconditional and must accept all conditions in the procurement documents. It must include a fully completed price table in the required format, including all unit-price fields, and must take account of the applicable management-system document V178 completion guidance. The bidder must provide the name, position and contact details of the person or persons signing the contract and the contract-performance contact person; a power of attorney must be added if signing authority does not arise from the articles of association. The bidder must also identify and justify any business secrets, noting that the bid price and other protected evaluation-related figures may not be classified as business secrets. Payment terms are 14, 35 or 45 calendar days depending on the contract value, or 95 calendar days under the contracting authority's factoring programme. Russian- or Belarusian-origin materials, equipment and goods, including components, may not be used, and certificates of origin may be requested.
