Compliance requirements

The bidder must confirm that the bidder, its management or supervisory body members and persons authorised to represent it have not, during the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Grounds for exclusion may include tax or social security payment debts; breaches of environmental, social or labour obligations; bankruptcy, liquidation or insolvency; an agreement with creditors; assets administered by a liquidator or court; suspended business activity; serious professional misconduct; anti-competitive agreements; conflicts of interest; serious breaches of previous public contracts; or the submission of false information and failure to provide required documents. For tax and social security debts, the notice states a threshold of EUR 0. The tax authority does not issue a tax-debt certificate where the total debt is below EUR 100 or payment has been deferred. Compliance with international sanctions and breaches involving the employment of unlawfully residing foreign nationals are also checked. Where an exclusion ground exists, evidence of remedial measures restoring reliability may be submitted in applicable cases. During contract performance, first-tier subcontractors will be checked. The bidder may not engage a subcontractor subject to replacement requirements or subcontractors or suppliers controlled or owned by Russian nationals, residents or entities established in Russia for more than 10% of the contract value.

Qualification criteria and exclusion grounds

The bidder must have completed at least one qualifying construction contract during the 60 months preceding the start of the procurement, either as the main contractor or as a subcontractor responsible for or coordinating all construction works. The requirement may be met through one of the following alternatives: - Alternative 1: a fully constructed or reconstructed land improvement system comprising at least 95 km of ditches, at least 120 culverts with a diameter of at least 400 mm, and at least 10 km or 50,000 m² of qualifying roads. - Alternative 2: fully completed renewal or maintenance of a land improvement system comprising restoration of at least 500 km of ditches and maintenance of at least 600 culverts with a diameter of at least 400 mm, plus construction or reconstruction of at least 10 km or 50,000 m² of qualifying roads. The bidder must provide the relevant contract details in the European Single Procurement Document. Upon request, the bidder must submit the prescribed list of contracts and confirmation from each client or main contractor that the work was properly performed. If relying on another entity’s capacity, the bidder must provide that entity’s details and consent. The bidder must have a responsible specialist for the land improvement works, or a person with equivalent competence, and must provide the person’s details and evidence of competence. For competence obtained abroad, a copy of the relevant licence or other document proving the right to perform the work must be submitted. The tender must include a EUR 4,000 tender guarantee in the form of a guarantee or deposit, valid at least until the end of the tender validity period. The prescribed price offer form, a compliant tender and, where necessary, evidence of equivalence must be submitted. A power of attorney must be included for a joint tender. The bidder must confirm compliance with RMK environmental requirements and workers’ rights and provide the required subcontractor information.
