Compliance requirements
The bidder must confirm that neither the company nor its relevant representatives have final convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking within the relevant five-year period or while an exclusion period remains in force. The exclusion grounds also cover tax or social security payment arrears, bankruptcy, insolvency or liquidation proceedings, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procedure, serious failures under previous public contracts, submission of false or incomplete information, environmental, social or labour-law violations, and certain national grounds concerning unlawful employment of foreign nationals, international sanctions and tax offences. The bidder must provide the required declarations and, where applicable, information and evidence concerning convictions, arrears, proceedings or remedial measures demonstrating restored reliability. The bidder must also confirm that the contract would not breach applicable international sanctions.
Qualification criteria and exclusion grounds
The machine-readable notice does not set out specific financial, turnover, previous-experience, personnel or certification requirements for bidder qualification; any such requirements must be checked in the official tender documents. The bid must comply with all procurement documents and may not be conditional. The bidder must submit a sales offer for the data-storage servers describing their technical parameters and price, and must enter the price according to the structure specified in the section for award criteria and rated indicators. The bidder must confirm technical compliance and explain any proposed equivalent solution, providing evidence of equivalence where necessary. The bidder must declare any trade secrets and justify that designation; the bid price and other indicators relevant to evaluation may not be classified as trade secrets. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers covered by the specified Russian ownership, residence or control restrictions, and that the goods are not subject to international sanctions or originating from sanctioned regions. Where a joint bid is submitted, a power of attorney for the authorised representative of the joint bidders must be included.
