Compliance requirements

The bidder, its management, administrative or supervisory body members, procurist or other authorised representatives must not have been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, terrorism, money laundering or terrorist financing offences. There must also be no conviction for enabling the employment of an unlawfully staying foreign national, breaching the employment conditions applicable to a foreign national in Estonia, illegal use of child labour or trafficking in human beings. The bidder must have no outstanding state tax, duty or environmental charge debt, or tax or social security debt under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous public contract, including termination, price reduction, compensation or a contractual penalty, or for providing false information or failing to submit required documents. The bidder must confirm that these exclusion grounds do not apply. Companies established in the Russian Federation or the Republic of Belarus are not permitted to participate.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the contract. At least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts including the performance period, information about the other contracting parties and the client representative’s contact details, as well as reference numbers for public contracts. The contracting authority may request evidence of proper performance. The team must include a person with valid switching authorisations who is registered in Elektrilevi’s partner portal before the tenders are opened. For works limited to 0.22–1 kV, at least low-voltage switching authorisation is required; in other cases, both low- and medium-voltage switching authorisations are required. The team must also include a person responsible for the work operation, registered in the same portal before the tender submission deadline, and a person leading the electrical works with valid A-level competence and/or a qualification corresponding to at least level 6 under the Professions Act, with the relevant proof and portal registration. The tender must comply with all procurement documents; conditional tenders or tenders containing additional conditions are not permitted. The bidder must submit a completed price table with all unit-price fields filled in, details of the contract signatory and contact person, and a power of attorney where necessary. In a joint tender, a power of attorney for the joint tenderers must be included. Materials, equipment, goods or components produced in or originating from the Russian Federation or the Republic of Belarus may not be used; the contracting authority may request certificates of origin.
