The bidder must confirm that neither the company nor its management or supervisory board members or authorised representatives have received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. Where relevant, the bidder must describe the conviction, the exclusion period and any measures taken to restore its reliability. The bidder must have no outstanding tax or social security contribution debt. For tax debt, amounts below EUR 100 or deferred tax debt are not reflected in the tax authority’s certificate. The bidder must also confirm compliance with obligations concerning the employment of illegally staying foreign nationals and confirm that it is not the subject of an international sanction. For checking exclusion grounds, the bidder must provide the names and personal identification codes of authorised persons who are not shown on the commercial register card, or confirm that no such persons exist. The required confirmations and, where applicable, details of electronically available evidence must be provided in the European Single Procurement Document.

The bidder must be registered in the commercial register of its country of establishment and provide its registration number and, where required, supporting evidence. During the three years preceding publication of the contract notice, the bidder must have properly completed, in accordance with good construction practice, at least one similar project involving the construction and installation of a fire-water tank. The reference contract must have had a value of at least EUR 70,000 excluding VAT. The European Single Procurement Document must describe the work and provide the contract value, signing date, performance period and location, as well as information about the other contracting parties. At the contracting authority’s request, the bidder must prove that the work was performed in accordance with the contract and good practice; for a public contract, the relevant procurement reference number must also be provided. The tender must comply with all tender document requirements, and conditional tenders are not permitted. The price must be submitted in the required structure together with the completed price breakdown form, with every blank cell filled in numerically. The total tender price must be stated excluding VAT. The bidder is responsible for the accuracy of the stated quantities, and unit prices must include all necessary installation work, delivery and storage of materials, labour, equipment, aids and other activities required to complete the works. The bidder must confirm compliance with the equivalence requirements and provide evidence of equivalence where necessary. The bidder may not use a subcontractor subject to an exclusion ground during contract performance. If the tender is submitted by a consortium, a power of attorney must be included identifying the authorised representative and lead consortium member and confirming joint and several liability. The tender must also include a description and justification of any trade secret, or a statement that it contains no trade secrets.
