The bidder must confirm that neither the company nor its representatives or controlling persons have relevant final convictions within the applicable five-year period, or an ongoing exclusion obligation, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The bidder must not have unpaid taxes or social security contributions. The notice states a EUR 0 threshold; under the applicable tax rules, a tax debt certificate is generally not issued where the debt is below EUR 100 or payment has been deferred. The bidder must also confirm that it is not bankrupt, insolvent, in liquidation, subject to comparable proceedings, under the control of a liquidator or court, or subject to suspended business activities. The bidder must not have seriously breached environmental, social or labour-law obligations, committed serious professional misconduct, entered into agreements aimed at distorting competition, or have an unresolved conflict of interest. It must not have participated improperly in preparing this procurement, previously caused an important public contract to be terminated early or triggered damages or comparable sanctions, or submitted false or incomplete information or failed to provide required documents. The bidder must also confirm compliance with national exclusion grounds concerning illegal employment of foreign nationals, international sanctions, tax-related offences and any participation restrictions based on the bidder’s country of establishment. Where an exclusion ground applies, the bidder may provide evidence of remedial measures where permitted by the applicable rules. The bidder must disclose authorised representatives who are not visible from the commercial register, including their names and personal identification numbers, or confirm that no such persons exist.

The bidder’s net turnover in the last financial year completed before the start of the procurement must be at least EUR 800,000. Joint bidders may add their turnover together. The contracting authority may request an extract from the latest annual report or other evidence of turnover; if the bidder relies on another entity’s financial capacity, that entity must provide the required consent, make the necessary financial resources available and assume joint and several liability for the relevant part of the contract. Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least one contract for construction works on a publicly used road, under which at least 25,000 m² of the upper asphalt-concrete layer was installed. The bidder must provide a list of the relevant works and, at the contracting authority’s request, confirmation from the client stating the performance period, installed area and proper completion. If the bidder relies on another entity’s technical or professional capacity, that entity must consent, describe the capacity relied upon and participate directly in contract performance at least to the extent of that reliance. The bidder must have an environmental management system meeting ISO 14001 or an equivalent standard. Compliance may be evidenced by an ISO 14001 certificate or confirmation from an independent auditor or accredited certifier. Reliance on another entity’s environmental management system is not permitted; in a joint tender, the system must be in place for all joint bidders and any relied-on entity where applicable.
