Compliance requirements

The bidder must confirm that no mandatory exclusion grounds apply to the bidder or to its management, supervisory or representative persons. These grounds include convictions for participation in a criminal organisation, breach of duty of honesty, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the illegal employment or unlawful employment conditions of foreign nationals, including payment below the statutory wage rate; unlawful use of child labour or trafficking in human beings; and outstanding state taxes, duties, environmental charges, taxes or social security contributions.\n\nThe contracting authority may also exclude a bidder that has seriously or repeatedly breached a material term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information about compliance with qualification requirements or failed to submit required information or additional documents.\n\nParticipation is not permitted for companies established or resident in the Russian Federation or the Republic of Belarus. The bidder must confirm that its place of establishment or residence is not in either country.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement during the 60 months preceding the start of the procurement. At least one of these contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party’s representative and contact details, and the procurement reference numbers where applicable. At the contracting authority’s request, evidence of proper performance must be submitted unless the information can be obtained from public or private databases without significant expense.\n\nThe bidder must have a person responsible for managing electrical works who holds a valid A competency or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, has the relevant certificate at the time of tender submission, and has been registered in the Elektrilevi Partner Portal before tenders are opened.\n\nThe bidder must have a person with valid switching authorisations for work-related switching operations in the 0.22–20 kV electricity network, including operational switching, isolation and earthing, re-energisation and restoration of the normal configuration, except in regional and distribution substations. The person must be registered in the Elektrilevi Partner Portal before tenders are opened. For low-voltage works only, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required, including where medium-voltage-side switching is needed for low-voltage works.\n\nThe bidder must have a person appointed as responsible for the work operation, who must be registered in the Elektrilevi Partner Portal before tenders are opened.\n\nThe tender must include a completed price table in the required format, with all unit-price fields filled in. The bidder must provide the required information on the authorised signatory and the contract-performance contact person; a power of attorney must be included if signing authority does not arise from the articles of association. The bidder must also identify and justify any trade secrets, or state that the tender contains no trade secrets. Materials, equipment and goods used in the works, including components, must not originate from Russia or Belarus; the contracting authority may request certificates of origin.
