Compliance requirements

The bidder must confirm that neither the company nor its directors, management or supervisory body members, authorised representatives or controlling persons have a final conviction within the last five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or illegal use of child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations. The bidder must confirm that entering into the contract would not breach national or international sanctions and that it has not enabled an illegally staying foreign national to work or breached the conditions for employing foreign nationals, including by paying wages below the statutory rate. Where an exclusion ground exists, evidence of remedial measures may be submitted if permitted by the applicable rules or tender documents. The bidder must complete the required declarations and provide supporting evidence where requested. For tax debts, the notice states that a tax debt certificate is generally not issued where the total debt managed by the same tax authority is below EUR 100, excluding interest not determined by an administrative act, or where payment has been deferred; foreign bidders are subject to the law of their country of establishment.
