Compliance requirements
The bidder must confirm that neither the company nor its management, supervisory body members, authorised representatives or other persons exercising control have relevant final convictions within the last five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must not have outstanding tax or social security payment obligations. The bidder must also confirm that no exclusion ground applies under national law, including enabling the employment of unlawfully staying foreign nationals or breaching their employment conditions, and that entering into the contract would not breach an international or national sanction. Where applicable, the bidder may provide evidence of remedial measures demonstrating restored reliability. The bidder must not use a subcontractor that is subject to mandatory replacement under the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder’s average net turnover over the last three completed financial years, covering 1 January 2023 to 31 December 2025, must be at least EUR 50,000 excluding VAT. The bidder must involve a responsible person or works manager throughout the contract period. This person must hold at least a level 5 Construction Works Manager qualification, or an equivalent or higher qualification, or a level 6 Chartered Construction Engineer qualification, or an equivalent or higher qualification. The bid must include the person’s name and professional certificate number. Equivalent qualifications must be supported by evidence; for persons qualified abroad, a copy of the relevant licence or professional certificate, or other proof of the right to perform the relevant work under the law of their country of origin, must be submitted. The bidder must also submit a compliant bid, confirm that any equivalence has been explained and evidenced, and provide the required joint-bid authorisation where applicable.
