Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds under Section 95(1) of the Estonian Public Procurement Act apply. These include relevant criminal convictions of the bidder or its management, supervisory body members, procurists or authorised representatives; convictions related to illegal employment or breaches of foreign workers’ employment conditions; unlawful child labour or trafficking in human beings; outstanding state taxes, duties or environmental charges, or tax and social security debts under the law of the bidder’s country; and being subject to international sanctions where contract award would breach those sanctions. The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations, insolvency or liquidation, serious professional misconduct, anti-competitive conduct, an unavoidable conflict of interest, an undue advantage arising from involvement in preparing the procurement, serious or persistent breaches of previous public contracts, false or misleading information, tax-related offences, or lack of the legal right to submit a tender. The bidder must provide the required confirmations and accurate supporting information.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. The bidder must provide extracts from the annual accounts for those years showing the turnover, unless the information is publicly available to the contracting authority from a database for an Estonian-registered legal person. At least six months must have elapsed since the end of the latest completed financial year by the tender submission date.
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one of those contracts must have had a value of at least EUR 100,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s details and contact information, and procurement reference numbers where applicable. Evidence of proper performance must be provided upon request unless the contracting authority can obtain it from public or private databases without significant expense.
The team must include a person responsible for leading electrical works with a valid A-level competence and/or a qualification of at least level 6 under the Estonian Vocational Qualifications Act. The person must hold the relevant evidence of qualification and be registered in Elektrilevi’s Partner Portal before the tender deadline. The bidder must also have a worker with switching rights for work-related operations in the 0.22–20 kV electricity network, including operational switching, isolation and earthing, re-energisation and restoration of the normal network configuration, except at regional and distribution substations. This worker must be registered in the Partner Portal before tenders are opened. For low-voltage-only works of 0.22–1 kV, at least low-voltage switching rights are required; in other cases both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side above 1 kV up to 20 kV. The bidder must also have a person responsible for the work operation, registered in the Partner Portal before the tender deadline.
The tender must include the price in the required price table, with all unit-price fields completed. Conditional tenders or tenders containing additional conditions are not permitted. The bidder must provide the names, positions and contact details of the contract signatory or signatories, identify a contact person for contract performance matters, and attach a power of attorney if signing authority does not arise from the articles of association. The bidder must confirm that its registered office or residence is not in Russia or Belarus and that materials, equipment, goods and components used in the works are not produced in or originating from Russia or Belarus; origin certificates may be requested. Joint bidders must appoint an authorised representative and submit the relevant power of attorney. The bidder must also identify and justify any trade secrets, while the tender price and other legally non-confidential evaluation figures may not be designated as trade secrets.
