Compliance requirements

A bidder will be excluded if the bidder or a person with management, representation or control functions has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering, enabling the unlawful employment of a foreign national, violating the conditions for a foreign national’s employment in Estonia, unlawful use of child labour or trafficking in human beings. The bidder must also have no outstanding state tax, payment or environmental charge debt, or tax or social security debt under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous public contract, or if the bidder has submitted false information about compliance with the qualification requirements or failed to submit required information or documents. The bidder must confirm that none of these exclusion grounds apply. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment or goods, including components, produced in or originating from Russia or Belarus may not be used in the works; the contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this tender. At least one of these contracts must have a value of at least EUR 40,000 excluding VAT. The bid must include a list of the contracts, stating the performance period, details of the other contracting parties and the contact details of the client’s representative, as well as the procurement reference numbers for public contracts. At the contracting authority’s request, the bidder must provide evidence that the contracts were properly completed. The team must include an employee with valid switching authorisations for switching operations related to the works in a 0.22–20 kV electricity network, and that person must be registered in Elektrilevi’s Partner Portal before the bid submission deadline. For low-voltage works only, at least MP switching authorisations are required; in other cases, both MP and KP switching authorisations are required. The team must also include a person responsible for the work operation, who must likewise be registered in the Partner Portal before the bid submission deadline. The team must include a person responsible for managing electrical works who holds a valid A-level competence or a qualification corresponding to at least level 6 under the Estonian Qualifications Act, has the relevant evidence of qualification, and is registered in Elektrilevi’s Partner Portal before the bid submission deadline. The bid must comply with all tender document requirements; conditional bids or bids containing additional conditions are not permitted. The bidder must submit the prescribed fully completed price table with all unit-price fields filled in, the details of the contract signatory and contact person, and, where necessary, a power of attorney. In the case of a joint bid, a power of attorney for the joint bidders must be included. The bidder must identify and justify any trade secrets or confirm that the bid contains no trade secrets; the bid price and prohibited evaluation indicators may not be classified as trade secrets.
