Ordering repair and maintenance works for small structures and recreational facilities

The bidder must not be subject to exclusion grounds, including a final conviction within the last five years, or an ongoing exclusion obligation, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour and other forms of human trafficking. Exclusion may also result from failure to pay taxes or social security contributions, breaches of environmental, social or employment obligations, bankruptcy, liquidation or another insolvency situation, suspension of business activities, an agreement with creditors, serious professional misconduct, anti-competitive agreements, a conflict of interest or involvement in preparing the procurement. The bidder must also not have had a previous procurement contract terminated early, or been required to pay damages or a comparable sanction, because of a serious breach of contract. Exclusion grounds also cover submitting false information, failing to provide required information or documents, improperly influencing the contracting authority’s decision-making process, or obtaining confidential information to gain an undue advantage. The contracting authority will also check compliance with rules on employing unlawfully residing foreign nationals, international and national sanctions, local tax debts owed in the contracting authority’s area, and the bidder’s right to participate in the procurement. Where an applicable exclusion ground exists, the bidder may submit evidence of permitted measures taken to restore its reliability.

The bidder’s net turnover in the field covered by the contract must have been at least EUR 50,000 in each of the last three financial years completed before the start of the procurement procedure. The relevant field is the performance of repair works and the resolution of emergency problems at small structures, recreational facilities or equivalent sites. The turnover data must be provided in the European Single Procurement Document. If the data are not available in a public database, the bidder must provide its three latest annual reports or extracts from them at the contracting authority’s request. The tender must comply with the procurement documents and the technical specification. The bidder must use the required price offer form and enter prices according to the structure provided in the evaluation worksheet, with two decimal places. The prices must include all direct and indirect costs necessary for proper contract performance; zero and negative unit prices are not allowed. The price form must contain no blank fields, amendments or additional conditions. The bidder must confirm that it holds the registrations and competences required to provide the service and must submit supporting documents at the contracting authority’s request. For checking exclusion grounds, the bidder must provide the names and personal identification codes of persons representing or controlling the company who are not visible in the relevant registers, or confirm that no such persons exist. A consortium must submit a power of attorney for its authorised representative. The bidder must identify and justify any trade secrets in the tender, confirm compliance with anti-corruption requirements, and comply with restrictions concerning sanctioned subcontractors and suppliers.
